Terms of Service

These Terms are an agreement between you and Datura AI Corp, a company incorporated in Saint Kitts and Nevis ("Lium", "we"). They govern lium.io, the Provider Portal, the API, the CLI and SDK (the "Service"). By creating an account or using the Service you accept them.

1. The Service

Lium is a marketplace for GPU compute. Independent providers connect their machines ("nodes"); renters rent GPU capacity on them as containers ("pods") at a per-hour price metered per second. Lium verifies nodes, matches renters with providers, meters usage, collects payment and pays providers. Lium does not own most of the hardware and is not a party to the workload you run. Documentation at docs.lium.io describes how the Service works and forms part of these Terms.

2. Accounts

You must be 18 or older. You are responsible for everything done with your account and its credentials (password, API keys, SSH keys); keep them secret and tell us at once if they leak. You must give accurate information and may not create accounts to evade a suspension or to collect promotional credit more than once.

3. Payment and refunds

The Service is prepaid: you top up a balance by card (processed by Stripe) or in supported cryptocurrencies, and pods draw on it per second for as long as they exist. Prices are shown before you rent. Top-ups are non-refundable; when the balance reaches zero, pods are stopped and removed and their local data is deleted. If a rental fails because of a fault on the provider’s node, the fees for that pod for the day of the failure and the day before are credited back to your balance, as described in the documentation; other fees for time a pod existed are not refunded unless the law requires it. Promotional credit has no cash value and may be withdrawn if obtained by breaking these Terms. Providers are paid a share of rental fees on the schedule published in the provider documentation.

4. Acceptable use

You may use the Service only lawfully and may not:
  • run workloads that are illegal, infringe others’ rights, or attack any network (including malware, phishing, spam and denial of service);
  • access or interfere with the host, other pods, other users’ data or Lium’s systems, or a renter’s pod if you are a provider;
  • mine cryptocurrency on a rented pod unless the documentation allows it;
  • use the Service from or for a person, entity or destination under comprehensive US, UK or EU sanctions (the Export Control and Sanctions Policy at docs.lium.io/security/export-compliance applies);
  • interfere with metering, billing, verification or scoring, or misrepresent your identity, location or hardware.

5. Content and software

You keep the rights to what you run on the Service and grant Lium only what is needed to run, store and transfer it as you instruct. Lium keeps the rights to the Service and its software; you receive a limited, revocable licence to use them under these Terms.

6. Termination

You may close your account at any time; unused balance is not refunded. We may suspend or close an account, stop pods or remove nodes if you break these Terms, if the law or a payment provider requires it, if we suspect fraud or abuse, or if we stop offering the Service. Sections 3 to 9 survive termination.

7. Disclaimer and limitation of liability

The Service is provided "as is" and "as available", with no warranty of uptime, performance, merchantability, fitness for a purpose or non-infringement; providers’ nodes are not under Lium’s control. To the extent the law allows, Lium is not liable for indirect, incidental, consequential or punitive damages or for lost profits, data or goodwill, and its total liability in any twelve-month period is limited to what you paid Lium in that period or 100 US dollars, whichever is more. You indemnify Lium against third-party claims arising from your workloads, nodes or breach of these Terms.

8. Governing law

These Terms are governed by the laws of Saint Kitts and Nevis; disputes go to its courts unless the law of your country gives you a mandatory right to sue at home.

9. Changes and contact

We may change these Terms; the current version and its date are on this page, and material changes are announced to account holders before they take effect. Contact: support@lium.io.
